미국 캘리포니아 공과대학(California Institute of Technology)이 삼성전자의 갤럭시 스마트폰이 특허권을 침해했다며 지난 3일(현지시간) 텍사스 연방 법원에 소송을 제기했습니다.

The California Institute of Technology went to Texas federal court Friday with a new lawsuit that says Samsung's Galaxy smartphones infringe the same patents that a California jury said Apple Inc. and its supplier Broadcom Inc. infringed to the tune of over $1.1 billion in damages.
The Pasadena-based private research university filed its lawsuit against the South Korean tech giant and its American arm in Marshall, Texas — home to one of the country's busiest patent litigation trial judges. Its latest lawsuit made repeated references to the 2016 lawsuit that the university hit Apple and Broadcom with in the Central District of California.
"As in the case against Apple and Broadcom, Caltech seeks a reasonable royalty from Samsung as compensation for its infringement," the school said in its Friday lawsuit.
A nine-person jury in Los Angeles had ordered Apple to pay more than $837 million and Broadcom to pay over $270 million to Caltech for infringing three of the patents that the institution is now accusing Samsung of infringing. In addition to those three, Caltech also says that Galaxy phones, among others, infringe two more.
The blockbuster verdict, however, has yet to clear its way through the appeals courts. In September, U.S. Circuit Judge Timothy B. Dyk cast some doubt on the infringement theory that Caltech used to convince the jury to sign off on those numbers, which were the same that the school's lawyers had asked for.
To justify the move to the Eastern District of Texas, the lawsuit pointed to one of the South Korean company's offices that is located in the city of Plano.
"Samsung has described this 216,000 square foot 'flagship' Plano office, with over 1,000 employees, as part of its 'longstanding and growing commitment to Texas,'" the lawsuit says. Samsung has also faced patent suits in Judge Rodney Gilstrap's court before; the company was hit with a $77.7 million infringement verdict by a jury there this March.
Caltech also noted that Samsung might have some trouble trying to get the patents invalidated at the Patent Trial and Appeal Board: Apple had filed 10 inter parts review petitions there, according to Friday's lawsuit, and the patent board "either denied institution or upheld the patentability of the claims in all ten petitions."
The lawsuit says that "sales and marketing material from Samsung and its suppliers" confirms that a collection of the company's products comply with industry standards that require error correction codes that allow faster data transmission over Wi-Fi networks. Those codes are covered by patents that Caltech owns, according to the suit.
As an example, the suit pointed to Samsung's Galaxy S4 phones, which contain a Broadcom Wi-Fi module that Broadcom's website says is compliant with the standards that Caltech says its patents cover. The lawsuit also cites reviews of Samsung products, such as a review that was published on AnandTech.com of the Galaxy S5 that claims the phones contain a Qualcomm module that "refers to or is similar to" a Qualcomm product that is also allegedly compliant with those standards.
Samsung, however, isn't the first tech giant to get hit with a patent lawsuit from Caltech after the university scored its $1.1 billion win in 2020. Caltech has sued Microsoft Corp., Dell Inc. and HP Inc. over infringing many of the same patents in U.S. District Judge Alan Albright's neighboring Western District of Texas court.
Judge Albright, however, issued a stay on those cases this August in order to wait out the ruling from the Federal Circuit in the Apple case.
